Terms of Service

These Terms of Service govern your use of MaxyMenu. By using the platform — whether as a restaurant operator or as a customer viewing a digital menu — you agree to these terms. MaxyMenu is a project in active development; please read these terms carefully.

1. About the Service

What MaxyMenu is

MaxyMenu is a digital menu management platform in active development, built for restaurant operators. It allows restaurants to manage and publish digital menus, receive and process update requests via WhatsApp, and deliver multilingual menu experiences to their customers via QR code or direct link.

Early-stage product

MaxyMenu is currently a work-in-progress project developed by Daniel Navarro Fernández. Features, workflows, and interfaces may change without prior notice. By using the service, you acknowledge that it is not yet a finished commercial product and may have limitations or interruptions.

2. Acceptance of Terms

Agreement

By accessing or using MaxyMenu — including viewing a demo menu, creating an account, or submitting menu update requests — you agree to these Terms of Service. If you do not agree, you should not use the service.

Changes to terms

We may update these Terms at any time. When we do, the 'Last updated' date at the top of this page will be revised. Continued use of the service after any changes constitutes your acceptance of the updated Terms.

3. Accounts and Responsibilities

Account creation

Restaurant operators may be required to create an account to access certain features. You are responsible for providing accurate information during registration and for keeping your login credentials secure.

Your responsibility

You are responsible for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at maxymenu@gmail.com. We are not liable for losses caused by unauthorised use of your account.

Eligibility

You must be at least 18 years old and acting on behalf of a legitimate business to use MaxyMenu as a restaurant operator. End customers viewing digital menus are not subject to account requirements.

4. Acceptable Use

Permitted use

MaxyMenu may only be used for lawful purposes related to restaurant menu management. You may not use the service in any way that violates applicable laws, infringes third-party rights, or disrupts the platform.

Prohibited conduct

You must not: submit false, misleading, or fraudulent menu content; attempt to gain unauthorised access to the system; reverse-engineer or copy any part of the platform; use automated tools to scrape or overload the service; or use MaxyMenu to transmit spam or malicious content.

Content you submit

You are solely responsible for the accuracy and legality of the menu content, images, allergen information, and other data you submit. MaxyMenu does not verify the accuracy of operator-submitted content.

5. Intellectual Property

MaxyMenu platform

All code, design, branding, and content that forms the MaxyMenu platform is the intellectual property of Daniel Navarro Fernández. Nothing in these Terms grants you any right to copy, reproduce, or distribute it.

Your content

You retain ownership of all menu content, images, and data you submit to MaxyMenu. By submitting content, you grant MaxyMenu a limited, non-exclusive licence to store, process, and display that content solely for the purpose of delivering the service.

6. Service Availability

No uptime guarantee

As an early-stage product, MaxyMenu is provided on an 'as available' basis. We do not guarantee continuous or uninterrupted access to the platform. Scheduled or unscheduled maintenance may cause temporary unavailability.

Modifications

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We will make reasonable efforts to notify active users of significant changes.

7. Limitation of Liability

No warranties

MaxyMenu is provided 'as is' without warranties of any kind, express or implied. We do not guarantee that the service will be error-free, secure, or suitable for any particular purpose.

Limitation

To the fullest extent permitted by applicable law, Daniel Navarro Fernández shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use MaxyMenu, including loss of revenue, data, or business opportunity.

Your responsibility for menu accuracy

Restaurants are solely responsible for the accuracy of published menu information, including allergen declarations. MaxyMenu is a tool for managing updates, not a guarantor of content correctness.

8. Governing Law

Applicable law

These Terms are governed by the laws of Spain. Any disputes arising from the use of MaxyMenu shall be subject to the exclusive jurisdiction of the courts of Spain, unless mandatory consumer protection law in your country of residence provides otherwise.

EU consumer rights

If you are an EU consumer, you may also have rights under the laws of your country of residence that cannot be waived by contract. These Terms do not affect those rights.

9. Termination

By you

You may stop using MaxyMenu and request account deletion at any time by contacting us at maxymenu@gmail.com. See our Data Deletion page for details on how your data is handled after termination.

By us

We reserve the right to suspend or terminate access for any user who violates these Terms, with or without prior notice depending on the severity of the violation.
